After being ordered by the Rabat Administrative Court to compensate a victim of AstraZeneca vaccination side effects, the Health Ministry has finally been exonerated, as the first instance verdict was overturned on appeal.
The Ministry appealed against the first ruling, which recognized the State’s responsibility towards the victim, in this case Najat Touati, who suffered physical disability as a result of the vaccine injection.
The lower court’s verdict was handed down last February, and was widely covered by the media, as the judges took an unprecedented decision that has laid the foundations for a body of case law on vaccination-related issues.
The case arose when Najat Touati, a biology teacher, filed a complaint against the State after suffering from Guillain-Barré syndrome.
The damage was corroborated by medical expertise. She won her case at first instance, being entitled to 250,000 MAD in compensation.
