The Moroccan Inter-Ministerial Delegation for Human Rights (DIDH) expressed, once Again, its surprise at Amnesty International’s biased attitude toward the death of a person while in police custody in Benguerir city (center).
The DIDH termed AI’s release on the detainee’s death conditions (on Oct. 6, 2022) as “blatant interference in a case that is still before courts”. The detention was ordered by the Benguerir Court of First Instance.
AI’s allegations of torture leading to death are surprising, given that the organization has taken over the role of the judiciary, and ignored the complexities of a case that is ongoing, the same source noted.
The DIDH said that the competent jurisdiction is the only party with the authority to rule on the relevance of the measures and procedures related to the guarantees of a fair trial.
AI is questioning the transparency of the investigations and legal proceedings, despite the fact that it does not have the prerogatives attributed to the parties to this trial, and can only follow the course of the trial in accordance with agreed human rights practices and give its remarks.
The DIDH affirmed that conducting field interviews and obtaining documents do not represent a solid argument for making observations.
The Delegation clarified that, contrary to the assertions contained in the said organization’s release, the competent authorities were abiding by the law by scheduling hearings for all parties involved, and using forensics and the necessary expertise during the investigation.
It recalled that four people were brought to justice over the suspicion of committing acts punishable by the law.
